This policy explains how Nyathi Corporation (Pty) Ltd ("Nyathi", "we", "us") collects, uses, and protects your personal information when you visit this website or place an order with us. We process personal information in accordance with the Protection of Personal Information Act 4 of 2013 ("POPIA").
Who is responsible for your information
Nyathi Corporation (Pty) Ltd, a company registered in South Africa, is the "responsible party" under POPIA for personal information processed through this website, including the PURE VODKA brand pages. You can reach us on WhatsApp at +27 81 013 3798.
What personal information we collect
- Order details — when you contact us via WhatsApp to place or enquire about an order, we receive your name, contact number, delivery address, and the contents of your message.
- Usage information — through Google Analytics we collect device and browser information, approximate location (city level), pages viewed, and how you found the site. This is collected using cookies and similar identifiers.
- Age confirmation — a temporary flag stored in your browser for the duration of your visit, recording that you confirmed you are of legal drinking age. It contains no personal details and expires when you close your browser.
We do not knowingly collect personal information from anyone under the age of 18.
Why we process it
- To respond to your enquiries and process, confirm, and deliver your orders.
- To verify that visitors are of legal drinking age, as required by the Liquor Act 59 of 2003.
- To understand how the website is used so we can improve it.
- To comply with our legal obligations.
We process this information because it is necessary to conclude and perform a transaction you have requested, to comply with the law, or in pursuit of our legitimate interests in running and improving the website — each a lawful basis for processing under section 11 of POPIA.
Cookies and analytics
This website uses Google Analytics 4, which sets cookies to distinguish visitors and measure how the site is used. The information generated is transmitted to and stored by Google. You can prevent analytics cookies by adjusting your browser settings, using your browser's private/incognito mode, or installing Google's opt-out browser add-on. The website remains fully usable without analytics cookies.
Who we share it with
We do not sell or rent your personal information. We share it only with:
- Service providers — Google (analytics) and WhatsApp/Meta (messaging), who process information on their own terms when you use those services.
- Delivery partners — couriers receive your name, contact number, and delivery address solely to deliver your order.
- Authorities — where disclosure is required by law.
Cross-border transfers
Google and Meta may store information on servers located outside South Africa. Where personal information is transferred across borders, we rely on the safeguards described in section 72 of POPIA, including transfers to recipients bound by laws or binding agreements that provide an adequate level of protection.
How we protect and keep it
We apply reasonable technical and organisational measures to secure personal information against loss, unauthorised access, and unlawful processing, as required by section 19 of POPIA. We keep order information only as long as needed to fulfil your order, meet our legal and tax obligations, and resolve any disputes — after which it is deleted or de-identified.
Your rights under POPIA
You have the right to:
- Ask whether we hold personal information about you, and request a copy of it.
- Ask us to correct or delete personal information that is inaccurate, out of date, or no longer necessary.
- Object to processing based on our legitimate interests, or to direct marketing.
- Complain to the Information Regulator if you believe your information has been processed unlawfully.
